Chat Terms of Use

Safety Guidelines, Terms of Use and Privacy Notice for Chat

Entering a chat session through Orange will constitute acceptance of the terms of use. If you don't agree to abide by these terms of use, please don't enter our chat services.

The Orange Chat Service (“Chat”) which is owned and operated by Orange Home UK Limited of St James Court, Great Park Road, Almondsbury Park, Bradley Stoke, Bristol, BS32 4QJ ("Orange") gives the Orange community a place to meet, chat and share ideas. As in a real community, users of Chat are asked to respect other users. We have set out below the terms of use that will govern your use of Chat and have also included some guidelines we hope you find helpful. You must observe the conditions at all times. We hope you enjoy your experience with Chat.

Please read the terms of use carefully, entering our chat service indicates that you agree to be bound by these terms of use.

You must be 16 and over to use our chat service. Some areas may be restricted further to those above 18 years of age, and it is part of our terms of use that you may NOT enter these unless you are 18 years old or over.

For the protection of our users, you may not enter any Teen rooms, unless you are 16-18 years of age, or you have been given explicit permission in writing from Orange.

These terms of use refer to any Orange chat service provided by Orange Home UK Limited.

Rules For Using Chat
Users must not use Chat to harass, threaten or attack anyone or otherwise behave in any way that would cause annoyance or distress to other users. In particular users must not use Chat for the following purposes:

- To transmit or knowingly receive content and/or language that is in any way unlawful, threatening, and offensive or in breach of any obligations of confidence. This includes the use of swear words and the use of offensive nicknames.
- To post links to web addresses, except in their user profiles.
- To provide instructions for illegal or otherwise harmful activities.
- To transmit or knowingly receive information relating to (or include links to) pornography, pirated software and/or computer games or other counterfeit goods.
- To collect and/or distribute personal data concerning other users of Chat or Orange members without first obtaining their consent.
- To impersonate another person (whether a friend, family member, celebrity, Chat monitor, Orange employee or other Chat participant).
- For the purpose of commercial gain. This includes the transmission of advertisements and any other attempts to generate business from other users of Chat.
- Post chain letters or pyramid schemes.
- Users should not act in any way to disrupt the flow of an ongoing discussion. If a user does not wish to participate in an ongoing discussion, or wishes to discuss a non-related topic, they are requested to join another chat room.

Your Responsibilities
You are responsible for the safety of your personal information. We recommend that you do not disclose your name, address, e-mail address, telephone number or other personal information on-line, unless you wish to make your personal profile public, and do so at your own risk. Remember! Orange employees and Chat moderators will never request such details online.

If you do choose to disclose personal information online, please be aware that your information may be collected and used by others to send you unsolicited materials and may also be passed to third parties outside Orange. You may be held legally accountable for what you say or do online. In particular you may be held liable for any defamatory comments, threats and untrue statements or other illegal or fraudulent claims made by you. Your Login name to the service must be in accordance of these terms, and may not include words that are racist, profane, crude or otherwise offensive. You may be held accountable for any breach of the rights of a third party if you have not obtained their prior consent to the use of their property.

You agree and warrant that you will comply with the terms of any agreement required by the owner or licensor of any intellectual property rights as may exist in all software and information you access or post via Chat and to indemnify Orange against any action or cost suffered or incurred by Orange as a result of a breach by you of this term.

Best Practice Guidelines
All Users are responsible for the safety of their personal information. Orange recommends that Users do not disclose their name, address, email address, telephone number or other personal information online. No Orange employees or Chat moderators will ever request such details online.

Legalities 
Orange does not undertake to monitor every communication or monitor the conduct of every user of the Chat Service. Chat Moderators will be online from time to time in order to help ensure that other users are adhering to the conditions of use. Full details of our moderation policies are here.

In order to provide you with support or for security and abuse management reasons Orange reserves the right to take what ever steps are necessary to protect the security of Users including but not limited to either itself or via authorising its contractors to logging in using a specific profile of any User.

Orange cannot guarantee the prompt editing or removal of any content. Neither Orange nor its third party contractors will be liable for the content of any material accessed via the internet or any adverse treatment of any information placed by you anywhere on the internet or any loss or damage that you may suffer as a result. Orange does not endorse any opinions expressed by other users of Chat. Orange reserves the right at its sole discretion to remove material from Chat at any time. Chat consists of information posted by third parties. As a result Orange accepts no liability in respect to the accuracy or truthfulness of any advice, information or data posted on-line or any responsibility for the consequences of your acting in reliance on such information. This disclaimer does exclude liability for death or personal injury as a result of our negligence. If you fail to observe either these conditions of use or the Orange Conditions of Membership at any time, Orange reserves the right to exclude you (either temporarily or permanently) from Chat depending on the nature and severity of your breach. Orange reserves the right to deny access to Chat to repeated breaches of these conditions of use or our Conditions of Membership. Orange reserves the right to change these conditions of use at any time and will post details of the changes on-line.

Privacy

By accepting these terms of use you agree that Orange may release your information (both present and past) to relevant authorities and in compliance with current data protection and security regulations where Orange believes that you have breached the terms of use or have used Chat to commit unlawful acts. We also reserve the right to disclose your personal information where required to do so by law and where we deem it appropriate in response to complaints of a substantial nature.
